Pool Builder Lead Rocket (“Company,”) is dedicated to providing effective lead generation and marketing solutions to our valued clients. These Terms & Conditions (“Agreement”) outline the rights, responsibilities, and expectations of both parties when you (“Client” or “you”) engage our services.
1. Services: Pool Builder Lead Rocket (“Company”) provides lead generation and marketing services to clients on a month-to-month basis. Services include building marketing campaigns, managing ad accounts, and creating content to drive phone calls and website traffic for clients. All advertising campaigns, creative assets, keyword strategies, targeting parameters, and ad account structures created by the Company are proprietary and remain the sole intellectual property of the Company. In the event of service cancellation, the Company is not obligated to transfer or share these assets. This protection is in place to prevent misuse of industry-specific strategies and ensure the integrity of systems developed from years of specialization in the pool and spa industry.
2. Payment Terms: Clients are charged a monthly fee upfront, which is used to run ads throughout the month. Payment is due on the day the ad campaigns are set to begin and will repeat on the same date each month. The Company will not activate ad campaigns until payment is received. For Google Local Service Ads, payment is collected at the end of the month once the total number of leads is compiled. If paying by credit card, a 3% procession fee will be applied.
3. Termination: Clients may cancel services by providing written notice to the Company prior to the next month’s invoice date. No specific format is required, but the cancellation request must be clearly communicated. Upon termination, clients will retain access to their own accounts and data, but any advertising campaigns, creative strategies, keyword sets, or ad structures created by the Company will not be transferred or shared. These materials are considered proprietary and are not included in the scope of what is delivered upon cancellation.
4. Client Responsibilities: Clients are responsible for providing timely approval of campaign verbiage, targeting, messaging, and any other necessary information or access to accounts required for the Company to effectively manage the marketing campaigns.
5. Performance: The Company does not guarantee specific results, as the performance of advertising campaigns cannot be assured. The Company will work with clients throughout the month to discuss campaign performance and identify opportunities for improvement.
6. Privacy: The Company will not share any information about a client’s campaign with other businesses or clients. Client data is protected, and the Company has strict policies against sharing campaign data.
7. Website Development: If the Company is hired to build a website for a client, the client will own the website upon full payment. The Company may host the website on its server for a monthly fee of $20. If a client chooses to stop marketing services, they may continue hosting with the Company or transfer the website to their own hosting account with the assistance of the Company’s team.
8. Dispute Resolution: If a client is unsatisfied with the campaign performance, they may work with the Company to make improvements or choose to terminate services. The Company does not have an arbitration or mediation clause.
9. Limitation of Liability: The Company’s liability is limited to the total fees paid by the client. The Company is not responsible for any indirect, incidental, or consequential damages arising from the use of its services. The Company shall not be liable for any claims related to the non-transfer of proprietary campaign materials upon termination of services. Clients acknowledge and agree that such materials are the intellectual property of the Company.
10. Indemnification: Clients agree to indemnify and hold the Company harmless from any claims, losses, or damages arising from their use of the Company’s services or any content provided by the client.
11. Changes to Terms: If the Company makes changes to these Terms & Conditions, clients will be required to review and re-sign the updated agreement. Clients may terminate the agreement without penalty before the next renewal date if they do not agree to the changes.
12. Additional Services: The Company offers various add-on services that clients may opt into. Account managers will consult with clients to determine if these additional services are suitable for their needs.
13. Geographic Limitations: The Company will work with clients to agree on a targeting area for their marketing campaigns.
